Terms of Service

App: Phone Contacts & Calls

These Terms of Service ("Terms") constitute the agreement between you and the developer ("we", "us", "our") covering the Phone Contacts & Calls application (the "App"). Downloading, installing or using the App binds you to them. Where they are not acceptable, the App should not be used.

1. Nature of the Service

The App is a contact book combined with a dialer. It allows contacts to be organised and searched, calls to be placed and received, call history to be reviewed, a caller to be recognised before answering, and unwanted numbers to be blocked or filtered. Feature availability depends on the permissions allowed, on the device, and on whether the App has been set as the default dialer.

2. Free Tier and Subscription

The core contact and calling features are provided free of charge, and that tier is funded by advertising. A subscription has two effects: advertising is switched off and the premium features are opened. The features a subscription covers are listed within the App and may be extended or adjusted as the App develops.

3. Billing, Renewal and Cancellation

Subscriptions are sold exclusively through Google Play billing at the price displayed before confirmation. Unless cancelled beforehand, a subscription renews automatically at the end of each billing period, the charge being applied to your Google Play account under Google's terms. Cancellation is made in the Play Store under "Subscriptions", after which the subscription runs to the end of the period already paid for and access continues until then. Uninstalling the App cancels nothing — only the Play Store can end a subscription.

4. Refunds

Refunds are governed by the Google Play refund policy and are assessed and paid by Google rather than by us. Where a charge appears mistaken you may also write to us and we will assist so far as we can, though the final decision on any Play Store refund rests with Google.

5. Minimum Age and Purchases by Minors

Use is permitted from 13 years of age, or from any higher minimum age set by the law of your jurisdiction. Anyone aged between 13 and 18 requires the permission of a parent or legal guardian, who accepts these Terms on their behalf.

A subscription or purchase made by a minor is valid only where a parent or legal guardian consented in advance. An adult who allows a minor to use a device signed in to that adult's Google Play account is responsible for purchases made from it. The effective safeguard is purchase authentication within Google Play — requiring a password or fingerprint before each purchase — and we recommend enabling it on any device a child can access. Where an unauthorised purchase has nonetheless occurred, the Google Play refund process is the route to resolution.

6. Acceptance and Amendment

Use of the App constitutes acceptance of these Terms. They may be amended; whatever is published on this page, with its effective date, is always the operative version, and continued use after an amendment constitutes acceptance of it. Where an amendment is unacceptable, discontinuing use is the remedy available.

7. Data the App Uses

Subject to the permissions allowed, the App works with contacts, call records and related device data so as to provide dialling, caller recognition, call history and blocking. Particulars appear in our Privacy Policy, which forms part of these Terms. Personal data is not sold, and disclosure is confined to the providers identified there.

8. Your Obligations

The App is to be used for lawful purposes only. Responsibility for the way its dialling, blocking and reporting features are used — including compliance with the law of your jurisdiction — rests with you, as does the accuracy of the contact information you keep in it. The App must not be used to harass any person, to submit false spam reports, to interfere with emergency communications, to circumvent the subscription, or to obtain unauthorised access to any connected system. The App must in no circumstances be your sole means of contacting emergency services; the device's native emergency dialling must remain available at all times.

9. Controls Available to You

Permissions may be withdrawn in Android settings; contacts edited or deleted; call history cleared; blocked numbers released; the default dialer changed; and the App uninstalled — each at any time and at your sole discretion.

10. Proprietary Rights and Licence

The code, design, graphics and other materials originating with us are our property and are protected by intellectual property law. You are granted a limited, personal, non-exclusive, non-transferable licence to use the App, together with any premium features a subscription opens, for private and non-commercial purposes. Reproduction, modification, redistribution, sale and reverse engineering are prohibited without our written consent. Your own contacts and content remain yours throughout.

11. Advertising

Where no subscription is in force, advertising is displayed through outside networks such as Google AdMob. Any relationship arising between you and an advertiser exists solely between the two of you; we accept no responsibility for third-party advertising content or for the goods and services it promotes. Advertising ceases for the duration of an active subscription.

12. Disclosure

Information may be disclosed where the law requires it, or where reasonably necessary to prevent fraud or abuse, to protect the rights and safety of users, or to enforce these Terms.

13. Termination

You may end your use of the App at any time by uninstalling it — noting that a subscription survives uninstallation and requires separate cancellation in the Play Store. Access may be suspended or terminated by us without prior notice where these Terms are breached, where the law obliges us, or where continued provision would expose us to legal or operational risk. Provisions which by their nature should survive termination — proprietary rights, disclaimers, limitations of liability — continue in effect.

14. Exclusion of Warranties

The App is provided "as is" and "as available", without warranty of any kind, express or implied. No promise is made that operation will be uninterrupted or error-free, that every unwanted or spam call will be intercepted, that caller recognition will always be accurate, or that defects will be remedied.

15. Limitation of Liability

To the fullest extent permitted by law, we bear no liability for indirect, incidental, special, consequential or punitive damages — including missed or failed calls, loss of data, loss of contacts, loss of profit and device malfunction — arising from use of the App or any inability to use it, even where the possibility of such damage was made known to us.

16. Disputes

Please write to us first at the address below; the great majority of matters are resolved that way. Where informal resolution is unsuccessful, the dispute shall be determined under applicable law before the competent courts of the place in which the defendant is located, unless mandatory law directs otherwise.

17. General

Should any provision of these Terms be held invalid or unenforceable, the remainder continues in full force. A decision not to enforce a provision on one occasion operates as no waiver of it.
